Hi,

I have made a directory on googlepages.com named as LINKOPEDIA... When I did choose this name I didn't know that there is another LINKOPEDIA.com which already exists and it is also a web directory.

I found it later when I was almost done with my manual directory. So I just put a disclaimer on my site that I have no link with original linkopedia.com

My Site is not for a commercial purpose or anything that is real.. it is all FUN and my little effort to make a manual directory on googlepages.com

Now I am getting emails from original linkopedia.com that i have violated the copyright laws and seriously actions will be taken against me if I don't close my directory.

I excused them and have written a long EXCUSING DISCLAIMER on my site at

but they again emailed me and said I have no other way than to remove site as it is using their trademark name (linkopedia)

can anyone please help me that am I really violating the laws?

and can I continue my directory with this name? I don't know but I didn't have any aim to violate the laws or to use their name for MY site's promotion... nothing like that. It was just a co-incidence.

Please help me. I don't know what to do now :)

I spent 4 months on making my directory and just after 4 days of its launching the disaster happened with that.

If "Linkopedia" is a registered trademark then you are in the wrong.

Under no circumstances can you create a product of any sort under the name of a registered trademark.

For instance if i was to make a clothing product and called it Nike, then obviously I am in the wrong.

But, maybe you should just come up with a new name..

But really you should look up any information to see if LinkoPedia" is in fact a registered trademark, because if it is, you might want to listen to what these guys are saying and close up shop.

Any backup on this?

Correct SOLDIER,

Put simply by using linkopedia's name you are in clear violation of their copyright / trademark on the name which most companys will not take lightly. By putting the site online it is comercial use and you don't really have a leg to stand on imo.

It would have been more serious if you had of registered a domain with the keyword linkopedia as they would have served you with a C&D or equivalent, but take my advice and follow what they say (unless it sounds unreasonable as the case can be.)

Ignorance to copyrights and using other people sites names is no excuse a simple search on the name would of showed you they have been on the web since 1998

Your site will most likely be removed by Google, your disclaimer is not a legal statement and especially as your making profit (google adsense) by using their name your the one in the wrong.

Oh,

ADMIN, You are right that a simple search would show it but I didn't search it at that time.. I know no one will believe me for that :)

and I am NOT making any profit from it... just google ads are the only source of income. and i have earned only $0.05 :(


Ok, I am already getting very scared so now I am going to email them and trying to convince them to give me 15 days to make another site just like this and I will delete this one after the launching of new site. Let see if they agree.

Also, can anyone suggest me a good name that I can use instead of "linkopedia" - Just asking.

And if you go to this page http://linkopedia.go...ogrammer_needed You will see that I need a programmer for my next project. If anyone of you can join me I would be happy to work with him :)

Thank you for all your help and guidance. I really had no idea how serious this issue can be.

Dude did you not listen? You need to close NOW! ASAP! If you don't they have every intention to say "We have given you more than enough time to remove your site but you have chosen to ignore us. We will be taking further action"

So why you still have the chance and enough time to run without getting into some serious trouble, close your site immediately!

By placing adsense on the site you are making profit, or rather revenue which does not help your cause.

Take my advice, do not email them. By the time they have got it as Donna says Google will have removed your page as Google can be held accountable for the sites content just as much if not more so than you.

Do not be 'scared' though...it's nothing to panic about as long as you don't deal with it stupidly.

Google can also ban you from using adsense ever again on any site and google won't wait 2 weeks, just pull it down and count your 5 cents loss and move on. Add a topic suggesting site names buy a url upload your script and away you go.

Ok, I am going to DOWN the directory I made :)

ADMIN: Actually the site is completely maintained MANUALLY means there is NO script behind it. I manually do everything. thats why I am calling it a NON PROFESSIONAL site.

I have emailed them and asked them to please give me 15 days to switch to new site.

I am being very friendly with them to not to be in any kind of trouble. Lets hope for the best.

This time I will do full research on internet that the name I choose MUST not already exist.

In short:

1. The account is still open with the subdomain 'linkopedia'
2. The files are still present, and if Donna can find it...so can they.

The request was not to close the site, it was to remove it. :closedeyes:
