www.phpcow.com The ESPN template is one of their default templates, so I doubt there is any chance of a lawsuit. While their ESPN style is a tad different, the program comes with every option available to make it as close to 100% as you can get. Yes, our layout is a replica, but the images and graphics were drawn to suit the needs of our site, rather than a copy/paste deal. PhpCow also has the templates for CNN and the NY Times, among others...so I'm guessing they did what they needed to do legally to offer these templates.

If people could make layouts and just say, "Hey this is mimic of google" and all they did was make the white background grey, Google would get very upset.

Then your beef should be with PhpCow. The text (fonts) and backgrounds are built into the template. It's mostly a content management system. Plug in your content and it fills out the template....really, how is that any different they buying any other ready made template and plugging in your content. If PhpCow is able to offer this, then I doubt ESPN has a problem with it. Just like the EPSN font...anyone can download that for free from www.dafont.com

Leave it to a 16 year old..?
Anyway..
"Mimicing" ESPN Is a nice way of putting it as "WE RIPPED ESPN TEH HELL!!"
And using a publishing site AND a ready made template doesnt really make it your layout at all.. All you have done is supplied the content no designing at all really..
Anyway Im not going to get into arguments.. you obviously know your stuff as you're not 16.. you obviously won this argument by finding out my age so I will just leave

1) Font is too small
2) There is too much on the front page
3) Half the links aren't working (i know thats not your job)
4) Just because espn.com can't center doesn't mean you can't.....
